Summary

Energy Efficiency Standards for Public Facilities

Kansas statute requires that construction documents for the construction of a new building or major renovations for the “use or benefit of a state agency…prescribe standards for energy conservation which provide the highest level of energy conservation and efficiency that is practical” (K.S.A. 75-1259(d)). Especially, projects must comply with ASHRAE 90.1-2007 or the International Energy Conservation Code 2006 (K.S.A. 75-37,126 and K.A.R. 1-67-2 and 1-67-3).

State agencies owning the property must conduct an energy audit every 5 years (K.A.R. 1-66-2).

The Facility Conservation Improvement Program (FCIP) promotes and facilitates energy-saving projects in public buildings. FCIP helps local governments, school districts, universities, hospitals, and others implement energy-efficiency and deferred-maintenance projects with no upfront capital expenditures through energy savings performance contracting. Furthermore, FCIP's streamlined procurement process means there's no need to issue Requests for Proposals (RFPs). Since FCIP is funded through customer fees, no State funds are used. Fees are based on overall project cost and range from 4% on the smallest projects to just over 0.5% on very large projects. Fees can also be included in total project financing.
